General terms and conditions of online sales
These conditions of sale are concluded on the one hand by the company Ballerina-dancesport hereinafter called "B" and on the other hand, by any natural or legal person wishing to make a purchase via the website of "B" called hereinafter "the buyer".
Object
These conditions of sale are intended to define the contractual relations between B and the buyer and the conditions applicable to any purchase made through the merchant site of B, whether the buyer is professional or consumer.
The acquisition of one or more items through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by B.
B reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the items offered
The items offered are those listed in the catalog published on the site of B.
Most items are to be ordered during manufacture from the supplier and are not in stock in France.
Certain items are offered while stocks last.
Each product is accompanied by a description established by the supplier.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.
Prices
The prices appearing in the catalog are prices inclusive of tax in euros.
B reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include the costs of order processing, transport and delivery provided that they take place in the geographic areas provided below.
Geographical area
The online sale of the items presented on the site is reserved for buyers who reside in France, in the French overseas departments and territories, Monaco, as well as any other country in the European zone and for deliveries required in these geographical areas.
Orders
The buyer who wishes to buy one or more items must:
- fill in the identification form on which he will indicate all the contact details requested;
- validate the order after having checked it;
- make the payment under the conditions provided;
- confirm the order and payment.
The confirmation of the order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of it and the renunciation of availing oneself of its own conditions of purchase or other conditions.
All the data provided and the confirmation recorded will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
The seller will send confirmation of the recorded order by email.
Withdrawal
Buyers, non-professional individuals, have a withdrawal period of seven days from the delivery of their order to return one or more items to the seller for exchange or refund without penalty, except for costs back.
Payment terms
The price is due upon order.
Payments will be made by bank card; they will be carried out through the secure system ............ which uses the SSL protocol `` Secure Socket Layer '' so that the information transmitted is encrypted by software and that no third party cannot read it during transport on the network.
The buyer's account will be debited at the time of the order.
At the buyer's request, a paper invoice will be sent to him.
Deliveries
Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
The risks are borne by the purchaser from the moment the products have left the premises of B. In the event of damage during transport, the reasoned protest must be made to the carrier within three days from the delivery.
Delivery times are given for information only; it takes between 1 and 2 months of order processing, the manufacturing of the item at the supplier and the shipment from Ukraine to La Cadière d'Azur and to the buyer.
Guarantee
All products supplied by the seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.
In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it.
All complaints, requests for exchange or reimbursement must be made by post to the following address: 73 chemin des belles pierres, 83740 La Cadière d'Azur within thirty days of delivery.
Responsibility
The seller, in the online sales process, is only bound by an obligation of means; its responsibility could not be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.
Intellectual property
All elements of B's site are and remain the exclusive intellectual property of B.
Nobody is authorized to reproduce, exploit, repost, or use for any reason whatsoever, even partially, elements of the site whether software, visual or audio.
Any simple link or hypertext is strictly prohibited without the express written agreement of B.
Personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominal nature relating to buyers may be subject to automated processing.
B reserves the right to collect information on buyers, including by using cookies, and, if desired, to transmit the information collected to commercial partners.
Buyers can oppose the disclosure of their contact details by notifying it to B. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.
Archiving - Proof
B will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.
B's computerized registers will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Litigation
These online sales conditions are subject to French law.
In the event of litigation, competence is allotted to the competent courts, notwithstanding plurality of defendants or call in guarantee.
